TERMS OF USE — BITMON PHOTO

Application/Service: Bitmon Photo ("Service")

By accessing or using the Service, you agree to these Terms of Use ("Terms"). If you do not agree, do not use the Service.

1)Definitions

User / you:
person who accesses or uses the Service.
User Content:
images, logos, texts and any files sent to the Service.
Enhancement/Processing:
image enhancement operation (e.g., light/color/sharpness adjustment) by AI models and/or post-processing.
Credits:
units consumed to perform an Enhancement.
Subscription:
recurring plan that grants monthly credits; may include monthly balance and standalone balance (top-up).
Top-up:
standalone credit purchase.

2)Eligibility and account

  1. 2.1. To use the Service, you must have legal capacity and provide truthful information.
  2. 2.2. Login is done via Google. You are responsible for maintaining the security of your access and for all actions performed on your account.
  3. 2.3. We may suspend or terminate accounts in case of misuse, violation of these Terms, or legal requirement.

3)Scope of Service and limitations

  1. 3.1. Bitmon Photo allows you to upload images and generate enhanced versions for aesthetic and/or professional purposes (e.g., dental photographs in clinical standard).
  2. 3.2. Results may vary depending on photo quality, lighting and other factors. We do not guarantee specific results, perfection, or suitability for a particular purpose.
  3. 3.3. The Service may undergo maintenance, instabilities and changes. We do not guarantee uninterrupted availability.

4)Dental photos, health and professional responsibilitiesIMPORTANT

  1. 4.1. The Service is not a medical device, does not replace diagnosis, medical records, reports, or clinical evaluation.
  2. 4.2. You are solely responsible for:
    • obtaining necessary authorizations/consents from the patient and/or image owner;
    • respecting your professional board rules, ethics, and applicable laws;
    • deciding if the final image is appropriate for clinical use, marketing, documentation or other purposes.
  3. 4.3. We strongly recommend that you avoid sending data that identifies patients when not necessary (e.g., full face, names, documents, metadata).

5)Privacy and LGPD (operational summary)

  1. 5.1. By using the Service, you acknowledge that User Content may include personal data and, in dental context, sensitive health data (LGPD).
  2. 5.2. You declare that you have legal basis and/or valid consent from the data subject to send images to the Service, when applicable.
  3. 5.3. Data processing is governed by our Privacy Policy (separate document), which details:
    • what data we collect (Google account, images, logs, payments);
    • purposes (process images, prevent fraud, support, billing);
    • retention and deletion;
    • sharing with providers (Google, Stripe, infrastructure and AI);
    • data subject rights (access, deletion, etc.).
  4. 5.4. To operate the Service, we may process and transfer data to providers outside Brazil, according to applicable safeguards and contractual terms.
  5. 5.5. Minimization: you agree to send only what is necessary for the intended purpose.

Note: these Terms contain rules on responsibility and use; the Privacy Policy will detail the "how" of data/retention/security.

6)User Content: ownership, licenses and permissions

  1. 6.1. You retain ownership of your User Content.
  2. 6.2. You grant us a limited, non-exclusive, global license to:
    • host, store, reproduce, transform (including compression/resizing and enhancements), and transmit your content only to operate the Service, prevent abuse and comply with legal obligations.
  3. 6.3. Model training: by default, the Service may use third-party AI providers. The use of your content for training will depend on what is described in the Privacy Policy and Service settings. If there is opt-out/opt-in, it must be respected as implemented in the product.
  4. 6.4. You warrant that you have all necessary rights and authorizations to send:
    • photos of patients and/or third parties;
    • logos and trademarks;
    • any copyright-protected materials.

7)User logo and watermark

  1. 7.1. The Service may allow you to upload a logo and request discreet application on the bottom right corner of the final image.
  2. 7.2. You are responsible for ensuring you have the right to use the uploaded logo/trademark.
  3. 7.3. The Service will try to preserve the shape and legibility of the logo, but does not guarantee perfect compatibility in all scenarios (e.g., complex backgrounds, low resolution of the uploaded file).
  4. 7.4. You acknowledge that logo application may alter the utility of the image for certain purposes (e.g., clinical documentation), and you decide when to enable it.

8)Plans, credits, subscription, top-ups and refunds

  1. 8.1. The billing model may include:
    • initial free credits;
    • monthly subscription with renewable credits;
    • standalone purchases (top-ups).
  2. 8.2. Credit consumption: each enhancement consumes credits as indicated in the interface at the time of use.
  3. 8.3. Free and promotional credits have no monetary value, may expire according to offer rules and may be revoked in case of abuse or fraud.
  4. 8.4. Subscription and renewal: subscriptions renew automatically until cancellation. Cancellations and management preferably occur via Stripe Portal (or method indicated in the app).
  5. 8.5. Carryover and expiration: if there are accumulation/monthly credit limit rules, they will be informed in the interface and/or pricing page.
  6. 8.6. Refunds: except as required by law, credit purchases and already used periods may not be refundable. If there is a refund, it may involve revocation of unused credits and/or transaction reversal.

9)Referrals and anti-fraud

  1. 9.1. The Service may offer referral bonuses, subject to:
    • monthly limits per user;
    • anti-fraud validations;
    • requirement of "real use" by the referred (e.g., first enhancement completed).
  2. 9.2. We may suspend, revoke or adjust bonuses if we detect:
    • self-referral, duplicate accounts, registration farms, automation, promotion abuse;
    • attempts to circumvent limits, chargebacks, refunds, or violations of these Terms.

10)Acceptable use and prohibited conduct

You agree NOT to:

  • send illegal, offensive, abusive content, or that violates third party rights;
  • send images without authorization from the owner (including patients and third parties), when applicable;
  • send content that violates professional secrecy, confidentiality, LGPD and ethical standards;
  • attempt to circumvent credit limits, rate limits, or security mechanisms;
  • exploit vulnerabilities, reverse engineer, aggressive scraping, or unauthorized automated use;
  • use the Service for misinformation, fraud or prohibited content.

11)Service intellectual property

  1. 11.1. Bitmon Photo, its interface, brand, code, design and materials are our property or licensed.
  2. 11.2. You do not acquire rights to the Service beyond the right to use according to these Terms.

12)Third-party services

  1. 12.1. The Service integrates third parties, including (without limitation):
    • Google (login);
    • Stripe (payments);
    • AI providers (image processing);
    • infrastructure (hosting, storage, analytics).
  2. 12.2. Use of these services may be subject to their own terms. We do not control third-party services and are not responsible for external unavailabilities or changes.

13)Retention, deletion and backups (operability)

  1. 13.1. We may temporarily store files and logs for:
    • operating the Service;
    • credit audit, anti-fraud;
    • legal compliance and security.
  2. 13.2. Retention time and deletion options will be described in the Privacy Policy and/or Service settings.
  3. 13.3. We may maintain backups for a reasonable period even after deletion, for technical and legal reasons.

14)Security and incidents

  1. 14.1. We employ reasonable security measures, but no system is 100% secure.
  2. 14.2. You are responsible for good practices: not sharing credentials, using secure device and trusted networks.

15)Suspension and termination

  1. 15.1. We may suspend or terminate your access to the Service:
    • for violation of these Terms;
    • for security/fraud risk;
    • by legal determination.
  2. 15.2. You may terminate use at any time, canceling subscription when applicable.

16)Disclaimers and limitations of liability

  1. 16.1. The Service is provided "as is", without warranties of specific suitability, uninterrupted availability or perfect results.
  2. 16.2. To the maximum extent permitted by law, we are not responsible for:
    • indirect losses, lost profits, reputational damages;
    • clinical decisions made based on images;
    • misuse by third parties or without consent;
    • failures of external providers (Google/Stripe/AI).
  3. 16.3. When permitted by law, our total liability will be limited to the amount paid by you to the Service in the last 3 months, or $20, whichever is greater.

17)Indemnification

You agree to indemnify and hold Bitmon harmless from claims arising from:

  • sending content without authorization;
  • violation of third party rights;
  • illegal, unethical use, or outside these Terms.

18)Changes to Terms

We may update these Terms. If the change is material, we will notify you through the Service or email. Continued use after changes indicates acceptance.

19)Applicable law and jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil, with competent jurisdiction according to mandatory consumer jurisdiction rules when applicable.
